Terms of Service

1. Acceptance of Terms

Welcome to DuelRank ("we", "our", or "us"), a public founder challenge leaderboard available at duelrank.org (the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. The Service

DuelRank is a public leaderboard where products are ranked within categories. Every category has a stable base board that does not expire. A paid challenge is a clearly labeled advertisement that can place one product above a competitor for 24 hours. After a paid challenge expires, the category returns to its base ranking unless another active challenge is running. We may add, remove, or change categories, rankings, and features at any time.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you have the legal capacity to enter into these Terms and that the information you provide (including product and founder details) is accurate and not misleading. If you use the Service on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.

4. Submissions and Listings

When you submit a product, claim a profile, or post a public note, you retain ownership of the content you provide, and you grant us a worldwide, royalty-free, non-exclusive license to host, display, and promote that content in connection with the Service. Founder claims, product descriptions, and public notes must be truthful and not misleading. You are responsible for the accuracy of your submissions and for ensuring you have the right to publish the content and links you provide.

5. Payments, Pricing, and Refunds

Paid spotlights and challenges are processed by our payment provider. One payment buys one spotlight; users do not split payments between base rank and challenge rank. Prices are displayed before purchase and may change over time. Payments are non-refundable except where required by law or where we determine, in our sole discretion, that a refund is warranted (for example, when a listing is removed for violating these Terms). We may moderate, disable, or refund payments or placements when a listing violates these Terms.

6. Rankings and Results

Rankings on the Service reflect a combination of listing activity, claimed and featured status, and paid placements. We do not promise clicks, conversions, revenue, rankings, or business results. A paid placement does not guarantee a permanent or specific position, and rankings change over time. You should not rely on any position shown on the Service as a statement of fact about product quality or performance.

7. Prohibited Conduct

You may not use the Service to:

• Submit or promote scams, illegal products, adult content, impersonation, or malicious links.
• Post content that is false, misleading, defamatory, or infringing on the rights of others.
• Attempt to manipulate rankings, engagement, or the leaderboard through fraudulent, automated, or deceptive means.
• Interfere with the operation of the Service, including by hacking, scraping at scale, or abusing our systems.
• Use the Service to send unsolicited commercial messages or otherwise violate applicable law.

We may remove any listing, claim, or content that violates these Terms, and we may disable access for users who violate them.

8. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted in writing. 9. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, and we do not warrant that rankings or listings reflect verified facts about any product.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for all claims arising out of or related to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold us and our officers, employees, and agents harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your submissions, or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Service, remove listings, or disable placements at any time, with or without notice, if we believe you have violated these Terms or that your continued use poses a risk to the Service or other users. Upon termination, any rights and licenses granted to you under these Terms will cease, and provisions that by their nature should survive (including sections on disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws applicable in our jurisdiction, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts of our jurisdiction, and you consent to the exclusive jurisdiction of those courts, except where applicable law requires otherwise.
